Drivers Terms and Conditions

1. Introduction:

These terms and conditions ("Agreement") constitute a legal agreement between you (the "Driver") and RedTaxi ("Company") governing your enrollment as a driver in the RedTaxi platform.

2. Definitions:

The following terms have the following definitions in this Agreement:

• 2.1 The term "Driver" or "Users" refers to a person who registers with and uses the Application in order to offer passengers taxi services.
• 2.2 The term "Passenger" or "Customer" refers to someone who makes a taxi service request through the Application.
• 2.3 The term "Clients" refers to someone who makes a service, independently with drivers.
• 2.4 The term "Application" or "App" or "Portal" refers to the RedTaxi Driver Application for drivers.
• 2.5 The term "Wallet" refers to the pre-paid payment methods that are accepted through the RedTaxi Portal.
• 2.6 The term "Company" refers to RedTaxi.

3. Driver Terms and Conditions Coverage:

By accepting the Driver terms and conditions, you also agree to follow the RedTaxi Policies and Agreement. These documents, along with these terms, make up the whole agreement between you and RedTaxi. Additionally, for onboarding and background checks, you agree that RedTaxi can collect, store, and share information from your Aadhaar card with Third Party Vendors or Government Authorities

4. Outline of Services:

You understand and agree that RedTaxi acts only as a marketplace for managing and running the Portal by using its platform. In accordance with RedTaxi's preferences, the Portal shows the services you provide and enables payments with Cash, UPI or Wallets for passengers. However, By selecting the For hire option in this Portal, you are permitted to independently provide services to clients. If you provide services directly to clients, RedTaxi holds no responsibility or obligations under the terms of these agreements. Regarding the caliber of the services you offer, RedTaxi makes no warranties or representations.

5. Driver Eligibility:

"Driver eligibility" refers to the set of criteria or qualifications that individuals must meet to be eligible to work as drivers for RedTaxi. These criteria are typically established by the service provider and include a combination of legal, regulatory, and internal requirements.

• 5.1 Age: RedTaxi mandates that drivers be a minimum of 18 years old.
• 5.2 Driver's Licence: A valid driver's license is typically a fundamental requirement, and in some cases, a Commercial Driver's Licence (CDL) may be necessary for certain rides or vehicles.
• 5.3 Driving Record: A clean driving record without a history of major traffic violations or accidents is often a prerequisite.
• 5.4 Background Check: In order to protect the passenger’s safety and security, the driver shouldn't have a criminal record.
• 5.5 Compliance with Local Regulations: Drivers must comply with all local laws and regulations related to transportation services.

These eligibility criteria are in place to ensure that drivers provide safe, reliable, and high-quality services to passengers while complying with legal and regulatory standards.

6. Enrolment Process:

To enrol in the Service, a comprehensive process is in place to ensure the safety and reliability of our drivers.

• 6.1 First, you need to complete an online application form, providing essential details about yourself.
• 6.2 Following that, in order to register on the RedTaxi portal, you must upload copies of your driver's license, Aadhar card, and your live photo.
• 6.3 Additionally, completing induction program or telephonic overview session is mandatory to acquaint you with our platform's protocols and service standards.
• 6.4 Lastly, agreeing to the terms outlined in this Agreement is fundamental, cementing a mutual understanding and commitment between you and the service.

This comprehensive enrolment process is designed to ensure a high standard of service and trustworthiness within our network of drivers.

7. Acceptance of Ride Requests:

On the RedTaxi portal, Acceptance of ride requests is a critical aspect of the transportation service workflow.

• 7.1 Receive Ride Requests: Drivers receive ride requests through the RedTaxi Driver Application. These requests contain details such as the pickup location, destination, and passenger information.
• 7.2 Notification: Upon receiving a ride request, drivers are notified through the app, often accompanied by a sound and visual alert.
• 7.3 Acceptance Decision: The driver has the option to either accept or decline the ride request based on their availability, proximity to the pickup location, and other factors.
• 7.4 Acceptance Time Frame: The ride request must be accepted by the driver before the timer ends. If not, it will be forwarded to other nearby drivers.

Note: Ride Booking Requests are continuously provided to the driver until the rejection limit exceeds, then the driver can't be able to access the RedTaxi Driver App.

• 7.5 Confirmation: Once the driver accepts the ride request, the passenger receives a confirmation, including details about the driver (name, photo, and vehicle information) and the estimated time of arrival.
• 7.6 Confidential Customer Information: RedTaxi will provide the Driver with the confidential Customer information required for the proper execution of the Service once a Booking is assigned. The Driver shall maintain the confidentiality of this information.
• 7.7 Navigation: The driver uses the app's navigation system to reach the pickup location and then transport the passenger to the destination.
• 7.8 Cancellation: If a driver can’t fulfil the ride request, they may request to cancel it through the app, allowing the request to be redirected to another available driver.

The acceptance process is designed to efficiently match drivers with ride requests, ensuring a timely and convenient experience for both drivers and passengers. It also helps, optimize the overall efficiency of the transportation network.

8. Driver Obligations:

As a driver, your commitment to providing exceptional service is crucial to our platform's success. By agreeing to offer safe and reliable taxi services, you contribute to a positive and secure transportation experience for passengers.

• 8.1 Maintaining your vehicle in good working condition and presenting it as clean and well-kept enhances the overall passenger experience.
• 8.2 Ensuring the validity of your driver's license, the Fastag balance, and in certain situations, the original RC books that are required for travel.
• 8.3 Upholding a standard of courtesy and professionalism in all interactions fosters a positive reputation for both you and our platform.
• 8.4 Importantly, the timely resolution and continued safety are facilitated by the timely reporting of any accidents or incidents to the company.
• 8.5 The commitment to non-discrimination is fundamental, as we prioritize an inclusive and respectful environment for all passengers.

Your adherence to these principles is key to creating a reliable and welcoming taxi service for passengers.

9. Conduct and Professionalism:

You agree to conduct yourself in a professional and courteous manner when interacting with passengers.

• 9.1 Drivers are strictly prohibited from engaging in any form of discrimination against passengers based on race, religion, gender, sexual orientation, or any other protected characteristic.
• 9.2 We strive to ensure that all passengers are treated with respect and dignity, irrespective of their background or identity.
• 9.3 Any instances of discrimination will be taken seriously, and appropriate measures will be enforced to maintain a platform that prioritizes fairness, equality, and diversity.

10. Driver's Individual Commitments:

You have to keep to the company's standards for appearance, which include wearing a uniform (the provided uniform in cities where it's available). In other cities, neat and professional attire is mandatory.

• 10.1 Fulfilling accepted service requests promptly and efficiently.
• 10.2 Ensuring punctuality in picking up customers at the scheduled time and location.
• 10.3 Maintaining professional demeanor, refraining from any form of harassment, and ensuring a respectful and courteous interaction with passengers.
• 10.4 Adhering to all applicable laws and regulations governing transportation services.
• 10.5 Avoiding any nuisance, damage to RedTaxi property, or misbehavior with RedTaxi representatives.
• 10.6 Prioritizing customer safety during the provision of services and taking necessary precautions to prevent any harm.

11. Company Obligations:

• 11.1 As the Application Provider, we commit to fulfilling several obligations to ensure the seamless operation and satisfaction of both Drivers and passengers.
• 11.2 Our primary responsibility is to furnish a reliable platform that facilitates the connection between Drivers and passengers, fostering a smooth and efficient ride-sharing experience.
• 11.3 Recognizing the importance of effective communication, we are dedicated to offering comprehensive customer support to address any queries or concerns raised by both Drivers and passengers.
• 11.4 In the event of complaints, we pledge to conduct thorough investigations and resolve issues promptly, emphasizing our commitment to maintaining a trustworthy and customer-centric platform.

12. Ratings and Reviews:

Passengers may provide ratings and reviews based on their experience with you. The Company may use this feedback to assess your eligibility to continue providing services on the platform.

• 12.1 Rating System: Passengers can assign a Star rating, often on a scale of 1 to 5, to their Driver and Cab after completing a ride.
• 12.2 Feedback Comments: Passengers may have the option to leave comments, offering detailed feedback about their experience.
• 12.3 Communication: Ratings and reviews help drivers understand how well they communicate, navigate, and provide overall service.
• 12.4 Driver Performance: Drivers may receive ratings from passengers, reflecting the overall satisfaction with the ride.
• 12.5 Feedback for Improvement: Reviews often provide specific insights into areas where drivers excel or where they can improve.
• 12.6 Trust and Reliability: High ratings and positive reviews contribute to a driver's trustworthiness and reliability within the platform.

Note: Persistent low ratings or reports of misconduct may result in the suspension or termination of your driver account.

13. Confidentiality:

You agree to maintain the confidentiality of any proprietary information, technology, or trade secrets provided by the Company.
This obligation of confidentiality continues even after the termination of your enrolment.

14. Mitigation of Legal Risks:

You promise to cover and defend the Company, its affiliates, officers, directors, employees, and agents from any problems that might come up because of how you use the service. If you break the rules or fail to follow the terms, you agree to take responsibility for any negative outcomes.

• Your negligence or wilful misconduct
• Your violation of this Agreement

15. Termination:

The Company reserves the right to terminate your enrolment with notice, provided there is a valid reason, such as a breach of terms, safety concerns, or changes in business needs.

Upon termination, you agree to immediately cease providing services through the RedTaxi platform.

Governing Law:

This Agreement is governed by and constructed in accordance with the laws of Motor Vehicle Act,1988. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts.

Changes to Terms:

The Company reserves the right to modify, amend, or change these terms and conditions at any time. Any such changes will be communicated to you, and your continued use of the platform constitutes acceptance of the modified terms.

By enrolling as a driver in the RedTaxi, you acknowledge that you have read, understood, and agree to abide by these terms and conditions.
